May 20, 2013, Thressa Joan Weishuhn, age 18, of Sibley, IA, plead guilty to the Simple Misdemeanor charge of Assault. She must pay a criminal penalty surcharge and court costs of this case within 30 days. Weishuhn was also sentenced to thirty days in jail with all time suspended except for the time she has already served. The remaining 29 days are suspended in the form of informal probation to the Magistrate Court for a period of two years. These 29 days will be enforced if any conviction for a similar offense is entered during that period. She was arrested May 15, 2013, after it was reported that she assaulted someone at Sibley Central Park.
May 20, 2013, Osceola County Sheriff's Deputies arrested Cliff Edwin Garnett, age 29, of Sibley, IA, after receiving a 911 call about Garnett allegedly breaking a window and entering a residence. Garnett was charged with Trespassing and Criminal Mischief, both of which are Simple Misdemeanors.
May 19, 2013, Osceola County Sheriff's Deputies arrested Troy Edgar Harris, age 39, of Ocheyedan, IA and charged him with allegedly committing the following offenses; Domestic Abuse 3rd Offense, a Class "D" Felony, Obstruction of Emergency Communication, a Simple Misdemeanor, and False Imprisonment, a Serious Misdemeanor. The arrest stemmed from a 911 call made from the 5900 mile of 180th Street southwest of Ocheyedan.
May 14, 2013, Jedd Bradley Julius, age 30, of Sibley, Iowa, was found guilty of Domestic Abuse Assault Causing Bodily Injury, a Serious Misdemeanor. The Defendant is sentenced to imprisonment in the Osceola County jail for 60 days with all of the time suspended except for 25 days with credit for 25 days already served. He is required to pay a fine and 35% surcharge, sheriff's room and board fees, court costs and restitution of any court appointed attorney's fees; however, the fine and 35% surcharge are suspended pending satisfactory completion of all terms of probation. These terms include successful completion of the Domestic Abuse Intervention Program, obey all laws, Local, State and Federal, and complete all other monetary obligations set out in the judgment. Julius was arrested February 11, 2013 after he assaulted his girlfriend causing injury to her.
May 3, 2013, 3:19pm, Brenda Krogman, age 50, of Ashton, Iowa, was driving a 2011 Chrysler 300 westbound in the alley south of 9th Street approaching 3rd Avenue in Sibley, IA. Florentino Espinoza, age 24, of Sibley, IA, was riding a bicycle southbound on the sidewalk on 3rd Avenue south of 9th Street. Espinoza collided with Krogman's vehicle as he attempted to cross the alleyway on the sidewalk. Krogman's vehicle sustained approximately $2000 damage. Espinoza's bicycle sustained approximately $100 damage. No injuries were reported.
May 3, 2013, Jordan James Johnson, age 23, of Elgin, IA, was found guilty of the crime of Possession of Marijuana, a Serious Misdemeanor. The Defendant is to pay total fines and surcharges of $1147.50, the costs of this action and restitution of any court appointed attorney fees, if any, all to be paid by no later than May 2, 2014. The Defendant if further sentenced to 60 days in the Osceola County Jail, all time suspended during a 2 year informal probation to the Sheriff. Johnson's original arrest was on November 10, 2012 when Osceola and O'Brien County Deputies investigated an underage drinking party. During the course of the investigation Johnson admitted the marijuana that was found belonged to him.
April 24, 2013, 5:38pm, on private property located in Sibley, IA, at 9th Street & 5th Avenue, Brooke Thompson, age 30, of Sibley, IA, was backing a 2005 Buick from a parked position and backed into a legally parked vehicle owned by Scott Solyntjes, also of Sibley. The Buick received $500 damage and Solyntjes' Toyota received $1800 damage. There were no injuries. Thompson was cited for unsafe backing.
April 17, 2013, 5:20am, on Hwy 60 1/4 mile south of 190th, south of Sibley, Henry Fisher, age 61, of Sibley, IA, was southbound on Hwy 60 in his 2001 Buick when he struck a deer that ran onto the roadway. There was $2200 damage to his vehicle. He was not injured.
April 17, 2013, 8:10am, at 200th St and Nettle Ave, 4 miles SW of Sibley, Paul Engelkes, age 48, of Rushmore, MN, was driving a 1998 Chevy southbound on Nettle Ave. Christina Matthiesen, age 41, of Ocheyedan, IA, was driving a 2002 Ford westbound on 200th St. Matthiesen failed to stop at the stop sign and hit the Engelkes vehicle broadside. Engelkes had to be extricated from his vehicle by the Sibley Fire & Rescue and was transported to the Osceola Community Hospital by the Osceola County Ambulance Service. Matthiesen was written a citation for failure to obey stop sign. Her vehicle sustained $4000 damage. Engelkes' vehicle sustained $2000 damage.
April 17, 2013, 11:00pm, on Hwy 60, 2 miles NE of Sibley on the overpass on Hwy 9, Hai Wah, age 38, of Grand Island, NE, was driving a 2004 SAAB owned by Doe Htoo, of Worthington, MN. He was northbound on Hwy 60 and had just crossed the overpass of Hwy 9 when he lost control of the vehicle. The vehicle entered the east ditch, going down the embankment and colliding with the hill/ditch. There was $1500 damage to the vehicle. Wah may have lost control due to the slushy condition of the roadway. He was not injured and was given a citation for failure to maintain control.
April 19, 2013, 2:00pm, 5 miles W of Sibley on A22, 1/4 mile east of McKinley Ave, Monty Mayer, age 41, of Sibley, IA, was driving a 2003 Jeep westbound on A22 when the vehicle hit a large area of slushy roadway. He lost control of the vehicle and rolled it into the ditch. Mayer was not injured. There was $1500 damage to his vehicle.
April 5, 2013, Osceola County Sheriff's Deputies arrested Kent Douglas Vink, age 21, of Doon, IA, and charged him with allegedly Operating While Intoxicated First Offense and Providing Alcohol to a Minor, both Serious Misdemeanors; Failure to Have a Valid Driver's License, Failure to Prove Security Against Liability, Interference with Official Acts and Possession of Drug Paraphernalia, all Simple Misdemeanors. Also arrested was Jennifer Ann Miller, age 19, of George, IA, for alleged Possession of a Controlled Substance and Unlawful Possession of a Prescription Drug, both Serious Misdemeanors; Possession of Drug Paraphernalia and Open Container, both Simple Misdemeanors. Devin Paul Groeneweg, age 20, of Ashton, IA was cited for alleged Possession of Alcohol Under Legal Age. The arrests stemmed from a traffic stop in Ashton for an equipment violation. Vink failed to stop for a deputy and then after finally stopping at a residence on 5th Street in Ashton, Vink fled on foot. Vink was located after a short search. Vink and Miller were transported to the Osceola County Jail. Vink was released after posting a $3200 bond. Miller was released after posting a $2600 bond.
March 28, 2013, the Osceola County Sheriff's Office arrested Rhiannon Shirlene White, age 34, of Sioux Falls, SD, on 8 warrants from Minnehaha County SD. The warrants consisted of 2 counts of Possession of Controlled Substance, Class 4 Felony, and 6 counts of Contribute to Abuse Neglect or Delinquency, Class 1 Misdemeanor. White was located at a rural residence west of Sibley and taken into custody by the Osceola County Sheriff's Office. White was extradited back to the State of South Dakota on March 29, 2013.
March 30, 2013, 10:39am, at the intersection of 5th Ave & 7th St in Sibley, IA - Sally Forrester, age 31, of Grimes, IA, was driving a 2005 Chrysler eastbound on 7th Street while Michelle Perry, age 39, of Sibley, IA, was driving a 2001 Ford southbound on 5th Ave when they collided in the intersection. Both drivers were transported to the Osceola Community Hospital by the Osceola County Ambulance Service with possible injuries. The Sibley Fire Department also assisted the Sheriff's Office Deputy at the scene. There was $7,000 damage to the Chrysler and $3,000 damage to the Ford. Perry was cited for Failure to Yield to Vehicle on the Right.
March 25, 2013, Paige M. Dather, age 25, of Melvin, Iowa was found guilty of Domestic Abuse-Assault, a Simple misdemeanor. The Defendant is sentenced to imprisonment in the Osceola County Jail for thirty (30) days with all but forty-eight (48) days suspended. She will serve any remaining portion of forty eight hours with credit for time served. The Defendant will also enroll in a State Licensed Counseling Program for Domestic Abuse-Assault offenders and successfully complete that program. The Defendant will also pay $60 in court costs and Sheriff's fees.
March 24, 2013, 7:28pm, 1/2 mile south of Bigelow, MN, on Hwy 60 - Kimberly Cuadros, age 17, of Sibley, IA, was driving a 2002 Suzuki SUV, owned by Amalia Rodriguez of Sibley, southbound on Hwy 60 and lost control on the icy roadway. The vehicle entered the west ditch and overturned onto it's top. The driver and her passenger were taken to the Osceola Community Hospital by the Osceola County Ambulance Service with minor injuries. There was $7,000 damage to the vehicle.
March 24, 2013, The Osceola County Sheriff's Office arrested Araon Gomez Gonzales, age 34, of Sibley, IA, for the offense of Domestic Assault (Simple Misdemeanor). The defendant was arrested after an investigation found that he allegedly had struck his live-in girlfriend after an argument. Gomez Gonzales is currently in the Osceola County Jail on a $300 cash bond and an ICE detainer.
March 23, 2013, 1:30pm, at A30 & 11th Ave, Sibley - Leroy Renken, age 48, of Sibley, IA, was driving a 1987 Chevy northbound on A30 pulling a fifth wheel trailer hauling a 10,000lb forklift. He attempted to make a right turn onto 11th Ave gravel access road when the chains came loose on the forklift. The forklift hit the front of the trailer, breaking the fifth wheel ball and lifting up the front tires of the pickup causing the pickup to be unable to stop or turn. The pickup ran over a stop sign and into the utility pole. There was $4,000 damage to the pickup and $500 damage to the trailer. There were no injuries. Renken was given a citation for not wearing a seatbelt.
March 22, 2013, 11:15am, on Pierce Ave 1/2 mile north of 220th St, NE of Ashton - Michael King, age 21, of Ashton, IA, was driving a 1992 Chevy pickup northbound on Pierce Ave and attempted to pass Juan Velez Garcia, age 54, of Worthington, MN, who was driving a John Deere tractor pulling a manure spreader belonging to Ron Thole of Ashton, IA. Velez Garcia had started making a left hand turn into a field drive. King collided with the tractor and manure spreader while attempting to pass. The pickup sustained $4,000 damage. There were no injuries. King was cited with unsafe passing and Velez Garcia was cited for failure to give continuous turn signal.
March 21, 2013, 5:15pm, on Hwy 9 1/8 mile west of Skyline Ave near Willow Creek - Dustin Taylor, age 25, of Spencer, IA, was driving a 1998 Volvo Semi eastbound on Hwy 9 when he crested a hill and observed another semi westbound in the eastbound lane. Taylor slammed on his brakes and swerved into the right ditch to avoid colliding with the other semi. He ended up colliding with a tree. The second semi never stopped. Taylor was transported by the Osceola County Ambulance Service to the Osceola Community Hospital with minor injuries. The Osceola County Sheriff's Office is investigating, trying to find the second semi that left the scene.
March 16, 2013, Dean Allen Sargent, age 39, of Sioux Falls, SD, was arrested by an Osceola County Deputy for allegedly Operating While Intoxicated 3rd Offense (Class D Felony). Sargent was also charged with 2 Counts of Child Endangerment (Aggravated Misdemeanors), 2 Counts of Failing to Secure Child Under 18 YOA, Fail to Prove Security Against Liability, Failure to Have Valid Driver's License (All Simple Misdemeanors). Sargent is being held in the Osceola County jail on a $10,000 cash bond. The arrest stemmed from a traffic stop northwest of Sibley.
March 12, 2013, Anthony Gene Heitman, age 30, of Paullina, IA was arrested by an Osceola County Deputy for a valid Osceola County warrant for allegedly Driving While Revoked, a Serious Misdemeanor. Heitman was also charged with Driving While Suspended and Failure to File SR-22 Insurance, both Simple Misdemeanors. The charges stemmed from a theft report taken in Ocheyedan on March 3, 2013. Heitman was released after he paid a $1900 cash bond.
March 5, 2013, an Osceola County Deputy arrested Ernest Christensen, 62, of Ocheyedan, IA, on the charges of Incest, a Class D Felony and Sexual Abuse 3rd Degree, a Class C Felony. Christensen allegedly committed a sex act with a child. He is being held on a $15,000 cash only bond in the Osceola County Jail.
March 2, 2013, Nick Gregory Schilling, age 22, of Sanborn, IA was arrested by an Osceola County Deputy for allegedly Operating While Intoxicated 1st Offense, a Serious Misdemeanor. Schilling bonded out of the Osceola County Jail on a $1000 cash bond.
February 23, 2013, at 12:00PM Neal Eisenbacher, age 45, of Spencer, Iowa was driving a 2012 Chevy Ambulance owned by the City of Spencer westbound on Highway 9 NW of Ocheyedan when he noticed a 2006 GMC Sierra driven by Wendy Swarthout, age 42, of Ocheyedan, Iowa cross the centerline. Eisenbacher tried to avoid a collision but was still sideswiped by the pickup. The ambulance has a damaged mirror, $1000 damage. The pickup has a broken mirror and shattered driver window, $500 damage. There were no injuries. Swarthout was cited for Failure to Yield Half the Roadway When Meeting A Vehicle.
February 1, 2013 at 8:35am Milton Brainerd age 70 of Sioux City, Iowa was driving a 2012 Toyota Avalon northbound on Hwy 60. The vehicle went through the median and cross the southbound lanes of Hwy 60 before coming to rest in the west ditch. The Toyota received approximately $4,000 in damage. Brainerd was cited for failure to maintain control. No injuries were reported.
January 29, 2013 at 6:24pm Olympia Zamorano-Sanchez age 29 of Sibley, Iowa was driving a 1998 Chevrolet Blazer. Zamorano-Sanchez was attempting to back from a parking space in the Pizza Hut parking lot when the vehicle slid on some ice and struck a legally parked 2007 Dodge Nitro belonging to Christopher Schwartze of Rock Rapids, Iowa. The Chevrolet received approximately $550 in damage. The Dodge received approximately $5,500 in damage. No injuries were reported.
January 27, 2013 at 7:45am Hugo Montejo Cruz age 21 of Worthington, Minnesota was driving a 1997 Ford F150 southbound on L58 and lost control on the roadway due to the ice and traveling too fast for conditions. The vehicle entered the west ditch and collided with two trees causing damage. The Ford, owned by Felix Montejo of Mankato, MN received approximately $6,000 in damage. Montejo Cruz was cited for failure to have a driver’s license. No injuries were reported.
January 27, 2013 at 8:30pm Kari Tjaden age 21 of Sibley, Iowa was driving a 1997 Ford Explorer northbound on Hwy 59 when she lost control due to the icy roads. The vehicle entered the east ditch and struck a utility pole. The Ford received approximately $1,500 in damage. No injuries were reported.
January 18, 2013 at 7:53pm Cynthia Steen age 54 of Ocheyedan, Iowa was driving a 1999 Suzuki Grand Vitara southbound on Hwy 59. Ovidio Orellana Galvez age 33 of Worthington, Minnesota was driving a 2000 Chevrolet Silverado northbound on Hwy 59. Steen swerved to avoid an animal in the roadway and crossed the center line colliding with Orellana Galvez. The Suzuki, owned by Thomas Binford of Worthington received approximately $5,000 in damage. The Chevrolet received approximately $5,000 in damage. Steen was cited for driving while revoked. No injuries were reported.
January 17, 2013, at 1:15pm Roger Lopau age 79 of Sibley, Iowa was driving a 2003 Buick Lesabre southbound on Oriole Ave when he fell asleep, crossed the center line, and struck the guard rail in the northbound lane. The Buick received approximately $3,000 in damage. The bridge also received approximately $3,000 in damage. Lopau was cited for failure to maintain control. No injuries were reported.
January 11, 2013, Rhonda Kay Fisher, age 52 of Ashton, Iowa plead guilty to Operating While Intoxicated 1st Offense, a Serious Misdemeanor. The Defendant is to pay a total fine of $1,697.50, the cost of this action, and restitution of any court appointed attorney fees, if any. The Defendant is sentenced to sixty (6) days in the Osceola County Jail with all time suspended except for two (2) days which must be served. The Defendant is placed on informal probation to the Sheriff for a period of two (2) years. The Defendant shall undergo a substance abuse evaluation and comply with the treatment recommendations, and successfully complete a course for drinking drivers. On February 20, 2012 Rhonda Fisher was stopped at Nettle Ave and 180th St. During the course of the stop Fisher was observed to have constricted pupils and body tremors. Fisher refused to do the field sobriety tests. The deputy was assisted by the Buffalo Ridge Drug Task Force.
January 11, 2013, Javier Michael Granados, age 23 of Worthington, Minnesota plead guilty to Operating While Intoxicated 3rd Offense, a class “D” Felony. The Defendant is to pay a total fine of $4,228.75, the cost of this action, and restitution of any court appointed attorney fees, if any. The Defendant is sentenced to the custody of the Director of the Iowa Department of Corrections for a term not to exceed five (5) years with all but thirty (30) days suspended. The Defendant is placed on formal probation to the Iowa Department of Correction for a period of two (2) years. The Defendant shall undergo a substance abuse evaluation and comply with the treatment recommendations, and successfully complete a course for drinking drivers. On June 30, 2012, Javier Granados was pulled over for speeding. During the course of the stop Granados was observed to have dilated pupils, slurred speech and bloodshot eyes. There was also a strong odor of alcohol coming from the vehicle. Granados failed field sobriety tests and consented to a breath test that tested over .08. Granados was arrested for Operating While Intoxicated.
January 9, 2013 at 11:33pm Patrick DeRocher age 60 of LeMars, Iowa was driving 1999 Ford F350 eastbound on Hwy 9 when he fell asleep. The vehicle crossed the centerline, entered the north ditch, ramped an embankment and went airborne until it crashed into the east creek embankment. The vehicle traveled in the ditch for approximately 100 yards and was airborne for approximately 25 yards before hitting the creek embankment. The Ford received approximately $6,000 in damage. DeRocher and a passenger in the vehicle were transported by the Osceola County ambulance to the Osceola Community Hospital with non-life threatening injuries.
January 2, 2013, at 9:45am Marie Godfredsen age 65 of Sibley, Iowa was driving a 2001 Buick Lesabre westbound on 11th St in Sibley, slowing to stop for the stop sign at 2nd Ave. Kevin Boer age 47 of Hospers, Iowa was driving a 2008 Buick Lucerne owned by Arnold’s Motor Supply of Sheldon, Iowa northbound on 2nd Ave and turned east onto 11th St when he failed to see the Godfredsen vehicle as he was making a left turn into Dyno’s. Godfredsen’s vehicle sustained approximately $3,000 in damage and Arnold Motors’ vehicle sustained approximately $2,000 in damage. Boer was written a citation for failure to yield upon left turn. No injuries were reported.
December 23, 2012 at 6:25pm Pamela Wehmeyer age 53 of Sibley was driving a 2004 Chevrolet Trailblazer northbound on Highway 60 when a deer ran out onto the roadway. The vehicle struck the deer with its front end. The Chevy received approximately $1,500 in damage. No injuries were reported.
December 20, 2012, at 12:35pm Ann Johnson age 46 of Ashton, Iowa was driving a 2003 Chevrolet Monte Carlo southbound on 2nd Ave in Ashton. Mark Burkett age 58 also of Ashton was driving a 1987 Dodge pickup eastbound on 6th St. Both drivers saw each other approaching the intersection but were unable to stop due to the snow on the roadway. The Monte Carlo received approximately $3,000 in damage. The Pickup received approximately $1,000 in damage. No injuries were reported.
December 18, 2012, at 3:05pm Monte Ray Molitor age 66 of Sibley, Iowa was driving a 1979 White Tractor westbound on 180th St and failed to stop at the railroad crossing. Molitor’s tractor was struck in the rear left side. The tractor sustained approximately $6,500 in damage. The train owned by Union Pacific Railroad sustained approximately $3,500 in damage. Molitor was transferred by private vehicle to Sanford Medical Center. He was also cited for failure to obey stop sign at railroad crossing.
December 14, 2012, Javier Utrera Cedillo, age 41 of Sibley, Iowa plead guilty to Operating While Intoxicated 1st Offense, a Serious Misdemeanor. The Defendant is to pay a total fine of $925.00, the cost of this action, and restitution of any court appointed attorney fees, if any. The Defendants entry of judgment is deferred pending successful completion of the probation requirements. The Defendant is placed on formal probation to the Iowa Department of Corrections for a period of one (1) year, and shall perform forty (40) hours of unpaid community service work. The Defendant shall undergo a substance abuse evaluation and comply with the treatment recommendations, and successfully complete a course for drinking drivers. On August 20, 2012 Javier Utrera Cedillo was stopped on 9th Avenue and 8th Street for an equipment violation. During the course of the stop, an Osceola County Deputy could smell an odor of an alcoholic beverage coming from Utrera Cedillo’s breath. Utrera Cedillo failed sobriety tests and tested over .08. Utrera Cedillo was arrested for Operating While Intoxicated.
December 14, 2012, Milton James Smith, age 52 of Harris, Iowa plead guilty to Operating While Intoxicated 2nd Offense, (Aggravated Misdemeanor). The Defendant is to pay a total fine of $2,507.50 the cost of this action, and restitution of any court appointed attorney fees, if any. The Defendant is sentenced to imprisonment in the Osceola County Jail for one (1) year with all time suspended except for thirty-six (36) days. The Defendant is placed on informal probation to the Osceola County Sheriff for a period of two (2) years. On March 21, 2012, an Osceola County Deputy was called to a residence in Harris for a person in need of assistance. Smith was sitting in a vehicle outside the residence and upon speaking to him there was an odor of alcohol on his breath. Smith consented to a breath test and tested over .08. Smith was arrested for Operative While Intoxicated.
December 14, 2012, at 3:39pm Lisa Sue Stevenson age 55 of Ocheyedan, Iowa was driving a 2006 Dodge Grand Caravan westbound on 220th St. Bradley Irven Block age 28 of Sibley, Iowa was stopped at a stop sign northbound on Redwing Ave in a Terra Gator. Block attempted to cross 220th St and struck Stevenson on the left side. The Dodge sustained approximately $6,000 in damage. The Terra Gator, belonging to the Cooperative Elevator Association of Ocheyedan sustained approximately $2,000 in damage. Swenson was transported by ambulance to the Osceola Community Hospital with non-incapacitating injuries.
December 11, 2012, at 11:50am Cindy Kaye Canode age 36 of Sibley, Iowa was driving a 1998 Chrysler Concorde northbound on 4th Ave in Sibley. Steven Franklin Bluearm age 31 of Sibley, Iowa was backing a 2001 Chevy 1500 from an alley between 3rd and 4th Ave and 8th and 9th St in Sibley and failed to see Canode and broadsided her. Canode’s vehicle sustained approximately $2,000 in damage. The Chevy, belonging to Coral Hernandez of Sibley sustained approximately $1,500 in damage. Bluearm was cited for unsafe backing and no insurance. No injuries were reported.
December 10, 2012, Jerry Lee Seivert, age 40 of Ashton, Iowa was found guilty of Simple Assault, a Simple Misdemeanor. The Defendant is to pay a fine of $100.00, the cost of this action and restitution of court appointed attorney’s fees, if any. The Defendant is sentenced to imprisonment in the Osceola County Jail for a term of thirty (30) days with twenty-nine (29) days suspended during a two (2) year informal probation to the Sheriff. On October 10, 2012, Seivert assaulted a male at a residence in Sibley, Iowa.
December 8, 2012, at 7:35pm Victor Martin age 32 of Rock Valley,Iowa was driving a 1994 Toyota pickup registered to Estela Lopez Lopez of Sioux City, Iowa. Martin was traveling southbound on Hwy 60 and lost control on the icy roadway. The vehicle entered the median and rolled onto its right side. The Toyota received approximately $4,000 in damage. Martin was cited for failure to have a valid driver’s license. No injuries were reported.
December 7, 2012, at 8:18pm Rhonda Jean Nelson age 47 of Windom, Minnesota was driving a 2004 Ford F250 registered to Janice Nelson also of Windom. Nelson was traveling southbound on Hwy 60 when she lost control on the icy roadway and entered the west ditch. The vehicle sustained approximately $7,500 in damage. Injuries were non-incapacitating.
December 6, 2012, at 9:04pm, Lynn Edward VanDyke, age 42 of Spirit Lake, Iowa was driving a 2005 Audi A4eastbound on A34 when a cow ran out onto the roadway. VanDyke struck the cow with the front end of the vehicle. The vehicle sustained approximately $10,000 in damage. Injuries were non-incapacitating.
